This website is operated by FACEPLANT. Throughout the site, the terms “we”, “us” and “our” refer to FACEPLANT. By visiting our site or buying something from us, you agree to the terms below.

If you do not agree to these terms, please do not use this site.

Who can order

You must be at least the age of majority where you live to place an order. You may not use our products for any illegal purpose, and you may not breach any law in your jurisdiction, including copyright law.

Products and pricing

Colours and images are reproduced as accurately as our screens and yours allow, and we cannot guarantee an exact match.

Prices are shown in US dollars and can change without notice. We may limit quantities, and we may refuse or cancel any order, including orders placed under a price that was listed in error. If we cancel an order you have already paid for, we refund it in full.

We may discontinue a product at any time. Offers are void where prohibited.

Accuracy of your information

You agree to give us current, complete and accurate purchase and account information, including a correct shipping address and email. Orders that fail because of an incorrect address are your responsibility.

Payment

Payments are processed by our payment provider. We do not store your full card details. You agree that we may charge the payment method you provide for the order total shown at checkout, including any tax and shipping.

Shipping, returns and refunds

Delivery times are estimates, not guarantees. Risk of loss passes to you once the carrier takes the parcel. Our shipping policy and return and refund policy form part of these terms.

Product use and safety

The FACEPLANT Pot is an indoor consumer product. Use it indoors, on a level surface, and charge it only with a standard USB-C supply. Do not submerge the electronics, do not open the housing, and keep it away from young children and pets who might chew the cable.

Readings shown on the screen and in the app are indicative and are there to help you look after a plant. They are not a guarantee of plant health, and we are not responsible for the condition of your plants.

The app

The companion app is provided as is. We may update, change or withdraw app features. A working app is not a condition of the product functioning, because the pot shows its readings on its own screen.

Third party links

Our site may link to third party material. We are not responsible for the content or accuracy of third party sites, and we are not liable for any harm related to them.

Your submissions

If you send us comments, photos, reviews or ideas, we may use, copy and publish them without restriction and without paying you. You are responsible for anything you send us, and it must not be unlawful, abusive or infringe anyone else’s rights.

Errors and omissions

Information on this site may occasionally contain typographical errors or inaccuracies. We may correct them and update information at any time without notice.

Prohibited uses

You may not use this site to break the law, to upload viruses or malicious code, to collect other people’s personal information, to spam, to scrape, or to interfere with the security of the site.

Disclaimer and limitation of liability

We do not guarantee that your use of our service will be uninterrupted or error free. The service and all products are provided as is and as available, except where the law says otherwise.

To the extent permitted by law, FACEPLANT is not liable for any indirect, incidental or consequential damages arising from your use of the service or any product. Where liability cannot be excluded, it is limited to the amount you paid for the product.

Nothing here limits any right you have under consumer law that cannot be waived.

Indemnification

You agree to indemnify and hold harmless FACEPLANT and its contractors from any claim or demand, including reasonable legal fees, arising out of your breach of these terms.

Termination

These terms are effective unless terminated by either of us. You may stop using the site at any time. We may end this agreement at any time if you breach these terms.

Changes to these terms

We may update these terms at any time by posting the new version on this page. Continuing to use the site after a change means you accept it.

Governing law

These terms are governed by the laws of the United States and the state in which FACEPLANT is registered.
